## Agreement to these terms
Welcome to trueffle.com (the "Site"). The Site is operated by Roumena Kratchunova, doing business as Trueffle, a sole proprietorship located at 176 Rose Street North, Twin Falls, Idaho 83301, United States ("Trueffle," "we," "us"). By accessing or using the Site, you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, please do not use the Site.
## What the Site is for
The Site exists to describe Trueffle's services, share our thinking through blog posts, and give prospective clients a way to reach us. Nothing on the Site is sold, and nothing on the Site creates a client relationship. Client engagements are governed by separate written agreements between Trueffle and the client, and those agreements take precedence over these terms wherever the two overlap.
## Information on the Site
We put effort into keeping the content on the Site accurate and current, but we make no promises that it is complete, error-free, or up to date. Blog posts and other content reflect our opinions and general observations about marketing and strategy at the time they were written. They are not professional advice tailored to your situation, and you should not rely on them as such. Any decisions you make based on content from the Site are your own responsibility.
## Intellectual property
All content on the Site, including text, graphics, logos, the Trueffle name, page design, and downloadable materials, belongs to Trueffle or is used with permission, and is protected by copyright and trademark law. You may view, download, and print pages for your personal, non-commercial use, provided you keep all copyright and other notices intact. You may not reproduce, distribute, modify, republish, or create derivative works from Site content without our written permission. Sharing a link to a page or post is always welcome.
## Newsletter
Subscribing to our newsletter is free and voluntary. By subscribing, you agree to receive emails from Trueffle at the address you provide. You can unsubscribe at any time using the link in any email. We handle subscriber information as described in our Privacy Policy.
## Blog comments
We welcome comments on blog posts. By posting a comment, you agree that:
- You are responsible for what you post.
- Your comment does not infringe anyone's rights, contain personal information about other people, or include spam, advertising, or links to unrelated sites.
- Your comment is not unlawful, defamatory, threatening, harassing, obscene, or hateful.
- You grant Trueffle a non-exclusive, royalty-free, perpetual license to display, reproduce, and use your comment in connection with the Site.
We may moderate, edit, or remove any comment for any reason, and we may block commenters who violate these terms. We are not responsible for the content of comments posted by others, and the views expressed in comments do not represent Trueffle.
## Acceptable use
You agree not to use the Site in any way that could damage, disable, or impair it, or interfere with anyone else's use. This includes attempting unauthorized access to any part of the Site or its systems, using automated tools to scrape or harvest content or email addresses, introducing malicious code, or using the Site for any unlawful purpose.
## Third-party links and tools
The Site contains links to other websites and uses third-party services such as Squarespace, Mailchimp, HubSpot, and Google. We do not control those sites or services and are not responsible for their content, availability, or practices. A link does not imply endorsement.
## Disclaimer of warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, Trueffle disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or free of errors or viruses.
## Limitation of liability
To the fullest extent permitted by law, Trueffle and Roumena Kratchunova will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Site will not exceed one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
## Indemnification
You agree to indemnify and hold harmless Trueffle and Roumena Kratchunova from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising from your use of the Site, your comments or other submissions, or your violation of these terms.
## Governing law and disputes
These terms are governed by the laws of the State of Idaho and the United States, without regard to conflict of law principles. Any dispute arising from these terms or your use of the Site will be brought exclusively in the state or federal courts located in Twin Falls County, Idaho, and you consent to the jurisdiction of those courts. Before filing any claim, you agree to contact us at roumena@trueffle.com and make a good-faith attempt to resolve the matter informally.
## Changes to these terms
We may revise these terms at any time by updating this page and changing the "last updated" date. Your continued use of the Site after a change means you accept the revised terms.
## General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and Trueffle regarding use of the Site.
